Is $400 Too Much for a BYOB License?

A story we ran Thursday morning stirred up quite a discussion among our readers. Where do you stand on the issue?

At their meeting at Abbot Hall Wednesday night, the Board of Selectmen unanimously approved a motion to enact the local BYOB regulations that they've been hammering out over the last two months and paved the way for as many as five carry-in alcoholic beverage licenses in town. The need for BYOB regulations was pushed to the forefront in September when Marblehead's new Mexican restaurant on Smith Street, Casa Corona, filed a request for permission to allow patrons to bringing along their own alcohol beverages. By law towns can charge fees for services PROVIDED the fee does not exceed the cost of providing the service. That is the issue here. The Selectmen appear to have arbitrarily chosen $400 as the fee because as the patch reported "some other town charges that." That is not what the law states. Selectmen Pave the Way for BYOB Licenses in Marblehead

The Board of Selectmen unanimously approved recently-crafted BYOB regulations pertaining to carry-in alcoholic beverage licenses in Marblehead.

Get ready Marblehead, you may soon be able to bring beer and wine along with you when visiting properly-licensed local restaurants, thanks to a decision made by the Board of Selectmen Wednesday night. At their meeting at Abbot Hall, board members unanimously approved the implementation of local BYOB regulations that they've hammered out over the last two months and paved the way for as many as five carry-in alcoholic beverage licenses in town. Selectmen Postpone BYOB Vote

No decision has been made regarding local carry-in alcohol license regulations.

At their meeting at Abbot Hall Wednesday night, the Board of Selectmen opted to postpone their planned vote on the most recent draft of carry-in alcohol license regulations after making several key changes. Prior to the vote, board members sat down with Assistant Town Counsel Lisa Mead to discuss the regulations, which were pushed to the forefront last month when Marblehead's new Mexican restaurant, Casa Corona, filed a request for permission to allow patrons to bringing along their own alcohol beverages. Selectmen Preparing to Vote on BYOB

The town's Selectmen are expected to make a decision regarding BYOB regulations in Marblehead at their meeting Wednesday night.

Town Administrator Jeff Chelgren asked that the Board of Selectmen "do their homework" when it came to reviewing recently crafted BYOB regulations in the hopes of bringing the matter to a vote at their meeting Wednesday night. Board members have been working with Town Counsel Lisa Mead to put together local regulations ever since Marblehead's new Mexican restaurant, Casa Corona, filed a request last month for permission to allow their patrons the option of bringing along their own alcohol beverages. "We're hoping that with this homework, that we'll be ready to vote on this Wednesday," Chelgren said. If the Selectmen are suportive of a growing downtown (not a certainty at all) then this should pass with little discussion. Question why limit it to five? Any restaurant should be able to have BYOB. Is there a state law limiting the number of licenses?   more ›

Would You Be Willing to BYOB to Local Restaurants?

In response to a recent request from Casa Corona Restaurant for permission to allow their patrons the option of bringing along their own alcohol beverages, the Board of Selectmen reviewed the local rules pertaining to BYOB at their meeting Wednesday night. Why are Liquor licenses typically sold by the restaurant when it is sold or closes and the previous grantee allowed to profit? Seems to me that license belongs state/town and should be made available to a qualified restaurant on a waiting list, at the normal licensing fee structure.   more ›

Why should they need a license at all? What statutory authority does the Town have to either require or issue such a thing? Do other municipalities issue BYOB licenses?   more ›
