Updated: School Administrator Faces Second OUI and Gun Charges

A Marblehead school administrator was released on $2,500 cash bail Tuesday after his arraignment on charges including OUI, second offense, and being a licensee carrying a loaded weapon while intoxicated.
Kevin Meagher, 47, 2 Pearl Road, Saugus, is also charged with negligent operation of a motor vehicle, marked lane violations and speeding.
A person who answered the phone at Meagher's address Tuesday said he was not at home and he had no comment.
On Monday night at 8:14 Meagher was stopped by police after his Ford Expedition almost hit a cruiser on the outbound side of Atlantic Avenue by CVS, officer Daniel Katz said in the police report.
"As the white Ford Expedition passed my cruiser, I was forced to abruptly pull my cruiser to the right side of the street to avoid being struck by the vehicle," Katz stated in his report.
"The vehicle came very close (to) taking off my front driver's side view mirror. The vehicle did not slow down as it passed my cruiser."
The officer estimated Meagher's vehicle was traveling 45 mph in an area with a 20 mph speed limit and full of businesses, parked cars and with pedestrians crossing the street.
The report also says that Meagher was repeatedly belligerent with the officer.
"I asked Meagher where he was coming from, and he stated back to me, 'Where were you coming from? Why does it matter? I am coming from work as a school administrator,'" the officer wrote in the report.
The officer said Meagher fumbled with his wallet and had trouble finding his license and registration.
The officer stated that Meagher slurred his speech, his eyes were bloodshot and glassy, and a strong odor of alcohol came from his breath.
Officer Katz asked Meagher if he was taking any medication.
"Meagher answered back to me in a belligerent manner, 'No. are you taking any medication?'" the officer stated in the report.
Another Marblehead officer arrived to provide back-up, Christopher Adkerson. Officer Katz asked him to speak to Meagher and offer his opinion as to whether the operator appeared to be intoxicated.
Officer Adkerson said in his report that he could smell alcohol on the driver's breath, and that he asked the driver where he was coming from?
"He stated, 'I just came from the Barnacle,'" Adkerson said in his report. "I asked him if he was drinking tonight and he said, 'yes.'"
As Officer Katz was placing Meagher in handcuffs, he saw a knife case in a center console cupholder.
He asked the man if he had any knives or weapons on him.
Meagher said he had a knife in his right front pocket, the report states.
An officer found a loaded Smith & Wesson 38-caliber handgun in a holster in the right pocket.
"Officer Adkerson asked Meagher why he did not inform us of the loaded handgun, and Meagher stated, 'I don't consider a gun a weapon,'" the report states.
Police also found a knife in his coat pocket and bottles of alcohol, nips. They were an empty and a full bottle of Grand Marnier Liquer and a bottle of Jameson Irish Whiskey.
Meagher refused to take a field sobriety test or a Breathalyzer.
And at one point, later, at the station, he repeatedly stared down police officers, Katz said.
Police said they found five empty 187ml bottles of Sutter Home Wine on the rear passenger side floor of the Ford Explorer. The bottles were still wet inside, Adkerson said in the report.
He also found a full unopened bottle, 50ml, of cognac.
Lt. Jon Lunt, who booked the suspect, stated in his report that Meagher smelled like alcohol and said that he had two beers at 8 p.m.
The booking officer, while doing an inventory of Meagher's belongings, found his Massachusetts license to carry a firearm.
The lieutenant confiscated the gun license pending possible suspension by the Saugus Police Department.
Meagher is scheduled for a pretrial hearing on March 11 in Lynn District Court.
At his arraignment the judge set conditions of his release: no alcohol, random screenings, not to operate a motor vehicle without a valid license, not to possess a firearm and surrender all firearms.
Meagher was formerly the Winthrop schools' finance director until he resigned in February 2011, according to an earlier Winthrop Transcript article.
He was hired as interim business manager for Marblehead schools before the start of the 2011 school year, according to an earlier Lynn Daily Item article.

This man was walking around the schools? Perhaps we need a metal detector for the administration? This is incredibly disturbing and even more disturbing is that we have not been contacted by Dr. Maas regarding his poor hiring choice.

acting tough arent you? Although I don't agree with how he said it, I think he was trying to say that he was carrying the gun after work and not on school grounds. This means that it was perfectly legal for him to carry the gun, except for the fact that he was drinking.

Who needs to act in Marblehead? Except for the fact he was drinking?? a clear indication he is not a responsible person. Otherwise the gun would be in his lock box for safe keeping while he enjoyed a few drinks..

Are you saying because he drinks he is not responsible? Mabey he wasnt planning on drinking. I would probally say that 99% of people with concela carry permits are responsible.
